Regarding the decision of the US District Court of New York in favor of BTA28.08.2018 06:24:28
JSC BTA Bank would like to inform that the US District Court of New York has issued a court order on compulsory submission of documents and giving testimony on oath by M.Ablyazov:
On August 01, 2018, Boies, Schiller & Flexner LLP ("BSF") filed a motion to compel M.Ablyazov to produce certain documents and designate an exact date for making sworn deposition.
Previously, on September 21, 2017, the Court had ordered M.Ablyazov to make himself available for filing documents and giving testimony in France. However, as of now, M.Ablyazov has failed to designate an exact date when he could submit documents and make deposition.
On August 10, 2018, Judge Katharine Parker, who is considering the case on the claim initiated by Almaty Mayor’s Office (Akimat) and JSC BTA Bank against M.Ablyazov, V.Khrapunov, I.Khrapunov and Triadou SPV S.A. in the US District Court of the Southern District of New York, ruled that M.Ablyazov should ensure his participation to give testimony in France no later than September 14, 2018, in case of failure to appear, M.Ablyazov will have to testify in Great Britain or in New York on the week beginning September 17 of the current year.
On August 13, 2018, Judge Katharine Parker publicly filed the above mentioned order which guarantees that M.Ablyazov simply must testify.
This decision was one of the interim results of BTA's performance in the proceedings against M.Ablyazov. In general, today all BTA’s efforts are focused on work coordination of legal advisors in New York, London and other jurisdictions in order to recover embezzled assets. BTA is optimistic on the positive outcome in all court proceedings.
